Frequently Asked Questions

Find answers to common questions about our legal services in Spain

Do I need a lawyer to buy property in Spain?

This is the most common question we are asked. As with buying property anywhere, you take a significant risk if you try to deal with the transaction yourself without expert legal support and so we strongly advise using a lawyer to assist you when buying or selling a Spanish property.

There are many reasons to hire the professional services of a Spanish solicitor specialised in real estate law. A specialised lawyer in property law can provide you with expert legal advice, protect your interests, and ensure that the buying or selling process is carried out properly and smoothly. An independent solicitor in Spain can act on your behalf and protect your interests during the sale and the purchase – including providing advice on negotiating the price. Make sure you are clear from the start what this legal advice will cost you!

In general, having a property lawyer ensures peace of mind and security in the buying or selling process.

Our law firm specializes in real estate law, with more than 20 years of experience advising expats is ready to help you with whatever you need. Contact us.

What will your lawyer check?

Before you pay any money beyond a reservation deposit, your lawyer will obtain the following information from the Land Registry.

• Who owns the property and has the right to sell it.
• If there are debts against it. For example, a mortgage or court judgement. Also, if the seller is up to date with the community fees and property taxes.
• If there are sitting tenants in the property.
• If it is subject to any special regulations such as subsidised housing.
• For new homes, if insurance is in place to cover structural defects.

What is the difference between resident and non-resident in Spain?

You are a non-resident in Spain if you live in the country for less than 183 days in a single year. If you are present for more than this, you are considered a resident. Non-residents pay taxes only on income from Spanish sources while residents in Spain pay taxes on their worldwide income.

Therefore, it is always advisable to consult a tax expert to determine a person's tax situation in Spain.

Do I need a NIE number to buy a house in Spain?

The NIE tax identification number is mandatory for all foreigners living in Spain and it is necessary for handling any legal, financial, professional, or social matters in Spain, regardless of whether you are a resident or non-resident. If you want to work, pay taxes or buy property in Spain, you need a NIE number.

Do I need the help of a lawyer to make my will?

If you are considering making a will to ensure that your assets and properties are transferred according to your wishes, it is advisable to seek legal advice from a lawyer specialising in estate law. An experienced lawyer can help you draft a will that complies with the legal requirements of your jurisdiction and ensures that your assets are transferred to the right people.

What should I do next if I want to make a Spanish will?

If you own assets in Spain and you would like to make a Spanish will to protect them, please get in touch with us. You can contact us by email at info@cslawyers.es by telephone on (0034) 952 967004 – (0034) 951832130, or by completing our contact form.

NIE number

We understand that foreigners or non-residents can have many linguistic and cultural problems in dealing with Spanish Authorities and other bodies. Steps to obtain documents such as Residence Permits, NIE number (fiscal Identification number), drivers’ license, etc. are normally not complicated but the process can be difficult if the right guidance and advice is not requested.

We have much experience in obtaining all kinds of documents for foreigners and non-residents, and can also arrange for the notarisation, legalising, apostilling of documents. We can help you to save time and avoid problems obtaining permits and documents on your behalf or advise you of the precise steps you have to follow to request them yourself.

Anyone from the EU can enter Spain without such an NIE number but cannot do many day to day things without one. If you intend to buy property, buy a car, take out insurance and many other financial transactions in Spain you will a NIE. Both husband and wife or partners wishing to conduct joint transactions will each need their own NIE.

Residence

Many foreigner in Spain don´t bother getting this, but the Spanish law says that if you have lived in Spain for more than three months and you plan on living in the country for more than 183 days per year, you have to apply for it. We have much experience in obtaining the residence for our clients so if you require assistance in this service, please do hesitate to contac us.
