Before you pay any money beyond a reservation deposit, your lawyer will obtain the following information from the Land Registry.
• Who owns the property and has the right to sell it.
• If there are debts against it. For example, a mortgage or court judgement. Also, if the seller is up to date with the community fees and property taxes.
• If there are sitting tenants in the property.
• If it is subject to any special regulations such as subsidised housing.
• For new homes, if insurance is in place to cover structural defects.
You are a non-resident in Spain if you live in the country for less than 183 days in a single year. If you are present for more than this, you are considered a resident. Non-residents pay taxes only on income from Spanish sources while residents in Spain pay taxes on their worldwide income.
Therefore, it is always advisable to consult a tax expert to determine a person's tax situation in Spain.
The NIE tax identification number is mandatory for all foreigners living in Spain and it is necessary for handling any legal, financial, professional, or social matters in Spain, regardless of whether you are a resident or non-resident. If you want to work, pay taxes or buy property in Spain, you need a NIE number.
