What Our Clients Say

Frequently asked questions

This is the most common question we get asked. As with buying property anywhere, you take a huge risk if you try to deal with the transaction yourself without expert legal support and so we strongly advise using a lawyer to assist you when buying or selling a Spanish property.
There are many reasons to hire the professional services of a Spanish solicitor specialised in
real estate law. A specialized lawyer in property law can provide you with expert legal advice, protect your interests, and ensure that the buying or selling process is carried out properly and smoothly. An independent solicitor in Spain can act on your behalf and protect your interests during the sale and the purchase including giving you advice on negotiating the price. Make sure you are clear from the start what this legal advice will cost you!
In general, having a property lawyer ensures peace of mind and security in the buying or
selling process. Our law firm specializes in real estate law, with more than 20 years of experience advising expats is ready to help you with whatever you need. Contact us.

Before you pay any money other than a reservation deposit, your lawyer will get the following information from the Land Registry.

• Who owns the property and has the right
to sell it.
• If there are debts against it. For example,
a mortgage or court judgement. Also, if the seller is uptodate with the community fees and property taxes.
• If there are sitting tenants in the property.

• If it is subject to any special rules
such as subsidised housing.
• For new homes, if insurance is in
place to cover structural defects.

You are a nonresident in Spain if you live in the country for less than 183 days in a single year.
If you are present for more than this, you are considered a resident. Non
residents pay taxes on any income from Spanish sources while residents in Spain pay taxes on their worldwide income.

Therefore, it is always advisable to consult with a tax expert to determine a person’s tax situation in Spain.

The NIE tax identification number is mandatory for all foreigners living in Spain and it is necessary for dealing with any legal, financial, professional or social affairs in Spain, regardless of whether you are a resident or nonresident. If you want to work, pay taxes or buy property in Spain, you need a NIE number.

If you are considering making a will to ensure that your assets and properties are transferred according to your wishes, it is advisable to seek legal advice from a real estate lawyer. An experienced lawyer can help you draft a will that complies with the legal requirements of your jurisdiction and ensures that your assets are transferred to the right people.

If you own assets in Spain and you would like to make a Spanish will to protect your assets, please be in with contact us. You can contact us by email at info@cslawyers.es by telephone on (0034) 952 967004 (0034) 951832130, or by completing our contact form.r.
